These Terms of Service ("Terms") govern your use of Southern Oregon Granite Design's website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Services

Southern Oregon Granite Design provides premium natural stone fabrication and installation services, including but not limited to:

  • Kitchen and bathroom countertop fabrication and installation
  • Fireplace surrounds and mantels
  • Outdoor kitchen and living area installations
  • Stone repair and refinishing services
  • Custom stone fabrication for architectural elements

Quotes and Estimates

All quotes and estimates provided by Southern Oregon Granite Design are:

  • Non-binding: All quotes are provided for informational purposes and are not binding contracts
  • Valid for 30 days: Quotes are subject to change after 30 days due to material cost fluctuations
  • Based on provided information: Accuracy depends on the completeness and accuracy of information provided by the customer
  • Subject to verification: Final pricing may be adjusted after on-site measurements and verification

Orders and Contracts

When you decide to proceed with our services:

  • A written contract will be provided detailing the scope of work, materials, timeline, and payment terms
  • A deposit may be required to initiate work, typically 50% of the total project cost
  • Payment terms and schedules will be clearly outlined in the contract
  • All change orders must be approved in writing and may affect the project timeline and cost

Customer Responsibilities

Customers agree to:

  • Provide accurate information: Supply complete and accurate project details, measurements, and requirements
  • Prepare the work site: Ensure the installation area is clean, accessible, and ready for work
  • Remove obstructions: Clear cabinets, appliances, and personal items from work areas
  • Maintain utilities: Ensure water, electricity, and other utilities are available as needed
  • Follow instructions: Adhere to any preparation or safety instructions provided by our team

Payment Terms

Payment for services is expected as follows:

  • Deposit: 50% deposit required before work initiation
  • Progress payments: Additional payments may be required at project milestones
  • Final payment: Balance due upon project completion and customer approval
  • Accepted methods: Cash, check, credit card, or electronic transfer
  • Late payments: Accounts overdue by more than 30 days may incur interest charges

Project Timeline

Project timelines are estimates and may be affected by:

  • Material availability and lead times
  • Weather conditions for outdoor projects
  • Customer decision-making and approvals
  • Site preparation and access issues
  • Unforeseen conditions discovered during work
  • Other projects in our production schedule

We will communicate any delays promptly and work to minimize their impact on your project.

Changes and Modifications

Any changes to the original scope of work must be:

  • Submitted in writing for approval
  • Accompanied by a change order detailing the modification
  • Approved by both parties before implementation
  • Subject to additional costs and timeline adjustments

Warranty and Repairs

We provide limited warranties on our workmanship:

  • Workmanship coverage: 2-year coverage on installation and fabrication
  • Material coverage: As provided by the manufacturer - we are not responsible for manufacturer defects
  • Service claims: Must be reported in writing within the coverage period
  • Exclusions: Damage caused by misuse, improper cleaning, or unauthorized modifications

Limitation of Liability

Southern Oregon Granite Design's liability is limited as follows:

  • We are not responsible for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for the services in question
  • We are not liable for delays caused by factors beyond our reasonable control
  • Customers are responsible for ensuring their property is adequately insured

Intellectual Property

All designs, drawings, and intellectual property created by Southern Oregon Granite Design remain our property unless otherwise agreed in writing. You are granted permission to use these for the specific project only.

Cancellation Policy

If you need to cancel your project:

  • Before fabrication: Deposit may be partially refunded, less administrative fees
  • After fabrication begins: Full payment may be required as materials are custom and non-refundable
  • Force majeure: Cancellations due to circumstances beyond our control may have different terms

Dispute Resolution

Any disputes arising from our services will be resolved through:

  • Negotiation: Both parties agree to negotiate in good faith
  • Mediation: If negotiation fails, mediation will be attempted
  • Legal action: As a last resort, disputes may be resolved in Jackson County courts

General Provisions

  • Entire agreement: These Terms constitute the entire agreement between parties
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign your rights or obligations without our written consent
  • Governing law: These Terms are governed by the laws of the State of Oregon
